Simple tools to understand common timelines and find official portals. General information only.

Cheque bounce deadline calculator

A cheque is valid for three months from the date written on it. These dates are a guide based on Section 138 of the Negotiable Instruments Act, and the safest dates are shown. Courts can sometimes condone delay, but do not rely on that. Check your dates with an advocate before acting.

Which forum?

This is a general guide to where such disputes are usually heard. The right forum depends on the facts, the contract and the current money limits, so check before filing.

What to bring to a first meeting

Cheque bounce

The original cheque and the bank's return memo; your demand notice with postal or courier proof; any reply received; the agreement, invoice or ledger showing the debt.

Property or RERA dispute

Agreement for sale or sale deed; payment receipts and demand letters; possession or allotment letters; all correspondence and the project's RERA registration details.

Legal notice received

The notice, with the envelope or proof showing the date you received it; the related agreement; earlier correspondence; identity proof.

Legal updates

General information on common legal questions. Not legal advice.

Delay in possession: what RERA lets a homebuyer claim

Where possession is delayed beyond the date in the Agreement for Sale, a buyer can generally seek a refund with interest, or possession with interest for the delay. The right route depends on the stage of construction and how much has been paid. Keep the agreement, receipts and written correspondence ready before approaching the Real Estate Regulatory Authority.

Cheque bounce under Section 138: the timelines

After a cheque is returned unpaid, a written demand notice must go to the drawer within 30 days of the bank's return memo. The drawer then has 15 days to pay. A complaint must be filed within one month after that period lapses. Missing any step can defeat the complaint.

Arbitration clauses: what to check before you sign

Check the seat of arbitration, how arbitrators are appointed, which rules govern, and whether any disputes (such as urgent injunctions) are carved out. A clause fixed at the drafting stage costs far less than one contested after a dispute begins.

What is the time limit for a cheque bounce complaint?

After the bank returns the cheque unpaid, a written demand notice must be sent within 30 days of the return memo. The drawer then has 15 days from receiving the notice to pay. If payment is not made, the complaint must be filed within one month after that period ends. Missing a step can defeat the complaint.

Can a homebuyer claim a refund for delayed possession?

Under Section 18 of the RERA Act, if a promoter fails to hand over possession by the agreed date, the buyer can generally seek a refund with interest, or stay in the project and claim interest for every month of delay. The right route depends on the facts, the agreement and how much has been paid.

Is a legal notice compulsory before filing a case?

Not in every case, but it is required in some, for example before a cheque bounce complaint under Section 138 and before a suit against the government under Section 80 of the Civil Procedure Code. In other disputes it is usually advisable, because it records your demand and gives the other side a chance to settle.

What is the difference between arbitration and a court case?

Arbitration is a private process that applies when the parties have agreed to it, usually through a clause in a contract. An arbitrator decides the dispute and the award can be enforced like a court decree, with only limited grounds to challenge it. A court case is a public process and is open to ordinary appeals.

Is an agreement to sell or a power of attorney enough to buy property?

No. The Supreme Court held in Suraj Lamp & Industries v. State of Haryana (2011) that a General Power of Attorney or an agreement to sell does not by itself transfer ownership of immovable property. A registered sale deed is the normal way to transfer title.

Do I need to register a rent agreement?

A lease of immovable property for more than one year must be made by a registered instrument. Shorter arrangements are often documented on stamp paper, and stamp duty rules differ by state, so check the requirements before signing.

What should I do if I receive a legal notice?

Do not ignore it. Note the date you received it, keep the envelope or delivery proof, collect the related agreement and correspondence, and reply within the time the notice gives. Consider speaking to an advocate before you reply.

How do I report an online banking fraud?

Tell your bank at once and report the fraud on the national cybercrime portal (cybercrime.gov.in) or by calling 1930. Under the RBI circular of 6 July 2017, reporting within three working days limits a customer's liability where the customer is not at fault.
